Key Provisions and Scope
The draft regulation applies to mobile phones and tablet computers that meet the following criteria:
- Devices used at a distance of less than 20 cm from the human body.
- Devices with a radiated transmit power exceeding 20 mW.
Testing and Certification Requirements
Manufacturers must be aware of several critical technical requirements:
- Testing Standards: Compliance must be demonstrated using recognized international standards such as IEC/IEEE 62209-1528, EN 50360, and EN 50566.
- Exemptions: Tablet computers without a "next-to-the-ear" speaker for voice calls may be exempt from head SAR requirements, provided technical documentation confirms the lack of such hardware.
- Market Surveillance: The regulator maintains the right to conduct market surveillance. If a device fails domestic testing, a one-time re-test of market-purchased samples is permitted at the manufacturer's expense.
The decree includes a transitional provision to account for domestic laboratory capacity. Until 31 July 2027, applicants may use a letter of information from a domestic laboratory regarding scheduled testing if a full report is not yet available. After this date, a complete SAR test report will be mandatory for all relevant Type Approval applications.
Manufacturers should evaluate their current R&D timelines and testing strategies to ensure business continuity as these requirements move toward full implementation.
