FCC Updates Delegation Rules

In this final rule, the Federal Communications Commission (FCC) modifies its rules on delegations of authority to streamline and harmonize how its Bureaus and Offices can adopt rule changes exempt from notice-and-comment requirements under the Administrative Procedure Act (APA). The FCC reaffirms that these internal delegations involve agency organization, procedure, or practice - thus not requiring traditional public input.

Key updates include: 
  • - Explicit authority for designated leaders (e.g., Managing Director, Bureau Chiefs) to make such rule changes if they are not new or novel.
  • - Standardized language across multiple sections of 47 CFR Part 0, ensuring uniformity in procedural delegations.
  • - Emphasis on compliance with APA exemptions for “good cause” and internal procedural rules.

The rule is effective as of August 4, 2025, and is not subject to the standard 30-day delay due to its procedural nature.
