Cybersecurity requirements for radio equipment for EU market

Commission Delegated Regulation (EU) 2022/30 was published in the Official Journal of the EU. This regulation supplements the application of the essential requirements referred to in Article 3(3) of Radio Equipment Directive (RED) 2014/53/EU.

Article 3 (3) of Directive 2014/53/EU specifies cybersecurity requirements for radio equipment that manufacturers, importers, and distributors must meet to market their wireless devices and products in EU. The three essential requirements are:
  • - Article 3 (3) (d) Network protection: radio equipment does not harm the network or its functioning nor misuse network resources, thereby causing an unacceptable degradation of service.
  • - Article 3 (3) (e) protection of personal data and privacy: radio equipment incorporates safeguards to ensure that the personal data and privacy of the user and of the subscriber are protected. 
  • - Article 3 (3) (f) protection from fraud: radio equipment supports certain features ensuring protection from fraud.

These essential requirements shall apply to any of the following radio equipment:
  •  - Internet-connected radio equipment: radio equipment that can communicate itself over the internet, whether it communicates directly or via any other equipment.
  •  - Radio equipment designed or intended exclusively for childcare
  •  - Toys and baby monitors
  •  - Radio equipment designed or intended, to be worn on, strapped to, or hung from any of the following:
    • (i) any part of the human body, including the head, neck, trunk, arms, hands, legs, and feet.
    • (ii) any clothing, including headwear, hand wear and footwear, which is worn by human beings.

This regulation will enter into force on 1 August 2024.
