FCC Issues Small Entity Compliance Guide

The Federal Communications Commission (FCC) released this Small Entity Compliance Guide (DA 25-803) pursuant to Section 212 of the Small Business Regulatory Enforcement Fairness Act of 1996.

The guide is intended to help small businesses, non-profits, and governmental entities comply with new rules adopted in ET Docket No. 24-136, FCC 25-27, aimed at strengthening the integrity of the equipment authorization (EA) program. 

Key points include:

Objectives: Ensure that TCBs, measurement facilities, and accreditation bodies are not owned or controlled by prohibited entities that pose national security threats.

Compliance Requirements:
  • - Certification that entities are not owned or controlled by prohibited actors (equity or voting interest ≥10%).
  • - Mandatory reporting of equity/voting interests ≥5%.
  • - Revocation of recognition for non-compliance or false information.

Recordkeeping & Reporting:
  • - Maintain signed certifications for SDoC processes.
  • - Update reports within 30 days of any ownership changes.
  • - Provide details of associated entities if named on the FCC Covered List.

Implementation: Rules are effective 30 days after Federal Register publication, with OMB approval required for certain reporting sections.
